On the 29th, the deputy Erika Hilton sent a letter to the National Council of Justice to facilitate the recognition of dual motherhood for children of lesbian couples created by home insemination.
This gestational method is widely used by lesbian couples due to the high cost of in vitro fertilization. Home insemination is performed by fertilizing the egg using a syringe with donor material in a residential setting.
However, when mothers go to register their children, there is discrimination in the CNJ Provisions for the registration of these children, meaning that the children of these mothers remain without dual motherhood registration until they reach the age of 12 and then, rights such as health insurance, pensions in cases of divorce, inheritance rights, family insurance and full family rights may be hampered.
To avoid this type of obstacle, mothers take legal action to obtain legal recognition as the mother of their children. With the project, Erika seeks to update the two CNJ provisions to recognize the rights of mothers who chose home insemination.
“I proposed in the Official Letter that Provisions 83/19 and 63/17 of the CNJ undergo editions that aim to address the obstacles experienced by lesbian women who use this method and their children. Children have the right to their mothers. Lesbian women have the right to their families and to full motherhood, if they so wish. And as a deputy, I will always work to guarantee these rights”said Erika on her social networks.
