McCormick’s lawsuit, filed hours later, asks the state court to ask countries to immediately count shipping cards without the required date handwritten on the returned envelope. This is the first – but not the last – lawsuit against Oz and McCormick, the former CEO of the Hedge Fund.

McCormick’s campaign claims that at least two countries – Blair and Allegheny – have proposed not to count ballots as part of the unofficial result that each country must submit to the state on Tuesday.

Oz, backed by former President Donald Trump, led McCormick with 992 votes, or 0.07 percentage points, from 1,341,037 votes reported in the state at 6:00 pm Monday.

The haste is close enough to allow the publication of the Pennsylvania Automatic Recalculation Act, which separates applicants within the 0.5% statutory limit. The Associated Press will not announce the In-race winner until the rough recount is completed. This may last until June 8th.

It is not clear how many ballot papers sent by post without dated manuscripts were received by the countries. While late in counting the votes, McCormick was better than Oz on the letter ballots.

Speaking on the conservative radio talk show in Philadelphia, McCormick insisted that “every Republican vote should be counted,” saying his campaign believes federal court decisions are valid in the states.

“I think Republicans should have a precondition that all Republican votes are counted, and that’s what we all think we’re doing in principle,” McCormick said. “And it’s a principle we’re following here. We had this principle before the court’s decision. This court’s decision has shed more light on this.”

Judging in a separate case late Friday, the U.S. District 3 Court of Appeals ruled that the state election law requirement on the return date of return envelopes next to the voter’s signature is “intangible . ” The lawsuit took root in district court elections last year, and a jury of three judges said they saw no reason to refuse to count ballots in that run.

The administration of Governor Tom Wolf said it would give countries instructions on how to handle ballots that influence the decision, though it has not yet done so.

The decision is contrary to the stance repeatedly made by Pennsylvania Republicans in the past in the courts to try to disqualify legal ballots issued by voters in a timely manner on technical issues such as lack of date. written by hand.

The law requires a person to write the date on the envelope in which they will be mailed on the ballot papers. However, the envelope is stamped by the post office and countries when they receive it.

State law, meanwhile, does not provide a basis for a voter to date an envelope and does not explicitly require a country to discard it if it does not have a date.

Attached to the lawsuit in the email as an exhibit, Blair County Attorney Nathan Carn told McCormick’s attorneys that the country will not count them “until a final decision is clear.”

The Federal Court of Appeals decision applies only to 10 Republican ballots in Blair County, Kern wrote.

But the decision appears to be ineffective until the court makes a conclusion justifying its action, Carney wrote, noting that the state has not issued guidelines – which countries are not obligated to follow – and that the decision of the court may be appealed. .
