The European Commission will approve a French measure to cancel domestic flights with an alternative option of less than 2:30 hours by train, with some adjustments, a source familiar with the matter said on Thursday.

The measure, a token provision of the climate law, is due to be reviewed after three years, but should not apply to connecting flights, according to our information. The decision could be officially announced on Friday. In December 2021, the European executive announced that it would implement a “deep analysis” to this project, which is being contested by the Union of French Airports (UAF) in collaboration with the European branch of the Airports Council International (ACI Europe). Discussions have taken place between the Commission and the French government to ensure that the project complies with European legislation.
The measure bans connections between Paris (Orly) and Nantes, Lyon or Bordeaux.
The European Air Services Regulation provides (Article 20) that a Member State may: “when there are serious environmental problems (…) that limit or deny the exercise of traffic rights, in particular when other modes of transport provide sufficient service”.. However, it specifies that these measures must be “non-discriminatory”, not reason “distortion of competition between air carriers”.not to be “More restrictive than necessary” and must have a “limited period of validity not exceeding three years, after which they are subject to re-examination.”.
