Luis VillanuevaDeputy Secretary General of the Federation of Civil Builders of Peru (FTCCP), warned that organizations such as the National Labor Inspectorate (sunafil) and other regulators do not have the competence or resources to conduct due diligence on violations of workers’ rights at the national level.
“Unfortunately, in Peru, not only sunafil and we organize them, who are regulators and inspectors, they do not only have sufficient competencies, but also sufficient resources to be present everywhere. We see that these are decorative formations, ”he said in News extension.
The leader gave an example of what is happening in mining sectorwhere, – he assured, – there are workers from outsourcing companies who earn less than half for doing the same work as the employees of the main company.
“In the mining industry, workers doing the same job under the same conditions, if they work for a third party, earn less than half as a worker doing the same job for the main company. Here, in PeruUnfortunately, there are bad employers who misinterpret and abuse the law,” he said.
Construction sector
Luis Villanueva He pointed out that in the construction sector alone, Sunafil is not enough to cover the entire area, for which, he warned, “a certain degree of informality exists.”
“In the construction sector, we work hand in hand with sunafil; but there are so many works at the state level, of various kinds, and so many violations and non-observance of social and labor rights that it cannot be sunafil everywhere,” he said.
When asked about the Labor Outsourcing Act, the leader indicated that the rules were in order, but warned that it was distorted by its provisions.
“Goal of distortion (sic) Outsourcing Law Through regulation, it was not to give specialized companies the opportunity to participate in the production process, but rather to differentiate workers in terms of remuneration. That is, to reduce the rights and wages of many workers,” he said.
“In the construction sector, there are collective bargaining agreements by industry and all workers have a pay scale based on our categories; and all employers, whether they are main companies or subcontractors, are required to comply,” he sentenced.
