The Supreme Court confirmed the legality of the requirements to the NBU to recover 1.8 billion UAH of debt from the ex-owner of the Bank Financial Initiative.
The Supreme Court finally confirmed the legitimacy of the recovery of 1.8 billion hryvnias in favor of the National Bank of Ukraine from the former owner of the bank, the financial initiative Oleg Bakhmatyuk. This is known by the NBU Press Service.
The civil court of cassation at the Supreme Court made the corresponding decision on January 22, rejecting the cassation appeal of Bakhmatyuk, the Press service of the National Bank.
The court also returned the decision of the court of first instance and appeal on the recovery of more than 1.8 billion UAH in favor of the National Bank from Bakhmatyuk as a guarantee for the financial initiative given in the refinancing loan.
In 2014, the bank concluded a refinancing loan with the National Bank to maintain liquidity in the amount of UAH 2 billion.
Oleg Bakhmatyuk, who owns the bank, entered into a guarantee agreement with the National Bank to ensure the return of the refinancing loan.
Since the owner of the bank did not fulfill the obligations under the guarantee agreement, the National Bank appealed to the Pechersk District Court of Kyiv with a claim for debt collection from Oleg Bakhmatyuk. On July 13, 2023, the Pechersky District Court of Kiev decided to recover 1.8 billion UAH from Oleg Bakhmatyuk. The Kiev Court of Appeal on June 05, 2024 left the indicated decision unchanged.
During the consideration of the court case, at the cost of the collateral provided by other guarantees to ensure the fulfillment of the obligations of PJSC, a financial initiative of the bank under an agreement to refinance Almost 200 million UAH happened.
Currently, six more cases remain under consideration by the Pechersky District Court of Kyiv on the claims of the National Bank for Oleg Bakhmatuk on the debts of PJSC Vieybi Bank and Pao Commercial Bank Penal Initiative.
The total amount of debt, imposed by the National Bank in Court with Oleg Bakhmatyuk, is about 7.9 billion UAH.
Recall that the Cassation Economic Court in the Supreme Court on November 26 confirmed the impossibility of returning the state privatbank to the former co-owner Igor Kolomoisky.
