Google wins legal challenge against EU fine of $1.7 billion

The European Commission said the tech giant abused its dominant market position in relation to its AdSense search product.

The EU General Court has decided to overturn a 1.49 billion euro ($1.7 billion) fine imposed by the European Commission on the US company Google in 2019 for market abuse related to its AdSense search product. CNBC reported this on Wednesday, September 18.

The case has been going on since 2019. At the time, the European Commission said the tech giant had abused its dominant market position in relation to its AdSense search product.

The product allows website owners to display search results ads on their pages.

Google acts as an intermediary that allows advertisers to place ads through search on third party websites.

At the same time, the European Commission argued that Google abused its dominance by writing a series of restrictive clauses into contracts with third-party websites, which ultimately prevented competitors from placing their search ads on those websites.

The European Commission fined the company 1.49 billion euros.

On Wednesday, September 18, the EU Court of General Jurisdiction ruled that “most of the European Commission’s findings can be upheld,” but “the decision in which the European Commission imposed the fine was set aside.”

The Court added that the Commission “did not take into account all the relevant circumstances in assessing the duration of the contract provisions” which it considered abusive.

We previously reported that including American Apple Inc. 13 billion euros will be recovered. And Google must pay a fine of 2.4 billion euros.

It was also reported that the French antitrust authority imposed a fine of 250 million euros on Google for failing to fulfill obligations to publications in the field of content licensing.
