The High Anti-Corruption Court (HACC) decided to close the Rotterdam+ case. The corresponding decision was made in an open meeting on Monday, October 9.

This is the fifth decision to close this case in the past two years, made by the Specialized Anti-Corruption Prosecutor’s Office (SAP), the High Anti-Corruption Court and the HACC Appeals Chamber.
In particular, today, during the preparatory proceedings, the panel of HACC judges decided to close the Rotterdam+ case on the grounds of clause 10, part 1, art. 284 of the Criminal Procedure Code of Ukraine, that is, the expiration of the period of pre-trial investigation determined by Article 219 of the current Code, after notifying the suspect.
DTEK believes that this decision confirms the legality and validity of the pricing formula for energy resources.
“DTEK always and consistently defends the position that the transparent pricing formula for energy resources based on import parity is the only correct way to develop Ukraine’s market economy,” said the energy holding and called the court’s decision fair.
They recalled that this principle was the basis for most of the energy market reforms of 2014-2016. It is supported and approved by Ukraine’s Western partners, including the IMF. Based on this principle, prices for coal, gas, fuel and other energy sources are determined.
We remind you that the investigation of the Rotterdam+ case lasted almost six years – from March 2017. During this time, the prosecutor’s office closed the case four times in the absence of evidence of a crime and reopened the investigation of four times.
