The High Anti-Corruption Court refused to arrest the request of the investigators to cover the debt obligations accrued by the state companies Ukrenergo and Energorynok to the DTEK group in the amount of almost UAH 8 billion.
“The arrest of these debts will further complicate the situation in the energy system before the heating season,” the company said in a statement.
“For more than 6 years of pre-trial investigation of the so-called Rotterdam+ case, not a single fact of committing a crime, causing damage or other illegal action was established, as a result of which the case was closed several times. Moreover, the legality of its closure was twice confirmed by the High Anti-Corruption Court of Ukraine,” – DTEK noted.
Akhmetov’s company added that at the same time, as part of this investigation, the court seized the personal property of two DTEK employees.
“During more than 6 years of investigation, DTEK officials met half of an objective investigation – they did not hide and did not hide their assets in any way. DTEK will do everything possible to protect the honor and dignity of its employees,” emphasized the authors of the message.
The investigation into the Rotterdam+ case has lasted since March 2017. During this time, the prosecutor’s office closed the case 4 times due to lack of evidence of a crime and continued the investigation 4 times. Three times the legality of the closure of the case was confirmed by HACS, including in the instance of the appeal.
“Both SAPO and VAKS confirmed the absence of victims in this case, the corresponding decision entered into legal force. The innocence of the suspects in the case and the absence of harm were confirmed by dozens of tests, including those state,” said DTEK.
We remind you that the investigation deals with the so-called Rotterdam+ formula, approved in 2016 by the National Energy and Regulatory Commission for calculating the wholesale market price for electricity, which includes the costs of transporting coal to Ukraine from the port in Rotterdam.
