The Cabinet of Ministers has submitted to Parliament a draft law on the digitalization of enforcement proceedings.
The Cabinet of Ministers is registered in the Verkhovna Rada bill No. 9363, which would authorize the arrest of debtors’ deposits and transfer them to pay the debt. The document was published on the government website.
The initiative provides for expanding the interaction of implementers with government agencies, banks, other financial institutions, non-bank payment service providers, and electronic money providers. Correspondence will also be introduced between the Unified Register of Debtors and other registers to prevent the removal of the debtor’s property (corresponding correspondence will be carried out automatically).

It is planned to improve the procedure for foreclosing the funds of debtors in bank accounts and other financial institutions. This will be carried out with the help of information communication between the implementers and specified subjects (automatic seizure of funds).
“The connection of banks, other financial institutions (non-bank payment service providers with the right to open payment accounts) in the communication of information will be mandatory,” the document said.
The bill proposes to take the deposits. Banking institutions, at the request of the bailiff, are obliged not to renew the deposit agreements, to inform the bailiff of the amount of the deposit, and then seize and transfer them to pay the debt.
“Remaining the debtor’s funds in deposit (deposit) accounts is not a reason for the bank to refuse to foreclose on them,” the document said.
After the bank receives a decision to take the debtor’s funds in the deposit (deposit) account, it is not allowed to extend the term of the term deposit agreement with the bank.
The bank transfers funds to the contractor’s account in the amount specified in the payment instruction for the forced debit of funds, and the balance of funds (if any) returns to the debtor in the manner specified by the agreement.
If there is information about the owner of the vehicle in the Unified Register of Debtors, the territorial bodies of the Ministry of Internal Affairs refuse to take the registration action. This rule used to exist, but has now been improved.
As you know, any citizen who is legally obligated to pay a debt (utilities, alimony, loan, etc.) can enter the Register of Debtors.
Since May, the bank accounts of such debtors have been frozen, regardless of the amount owed. But you can regain the right to use the amount of two minimum wages – 13,400 Hryvnia.
Recall that in 2022 in Ukraine, when it was forbidden to collect debts for utilities at the legislative level, almost 52,000 court cases were opened against communal debtors.
