On Tuesday, the Mexican Supreme Court ratified the presence of the army on the streets of the country in terms of public safety in the fight against organized crime by order of the President. Andres Manuel Lopez Obrador.
The plenary court, by an eight-vote majority, upheld the constitutionality of an August presidential decree ordering the withdrawal of soldiers and marines from the barracks to fight organized crime.
Thus, he established that head of state correctly exercised his powers under Article 5 of the Decree on Constitutional Reform, despite the fact that the chairman of the hall, Arturo Saldivarrejected that by this resolution the body would authorize the militarization of public security tasks.
“The fact that this Supreme Court confirms the participation of the armed forces in security tasks, even when other civilian institutions, such as the National Guard, complete their integration (…), in no way means that this court authorizes the militarization of public security” , he explained, according to the newspaper Excelsior.
The agreement also mentions that the armed forces will be guided by strict observance and respect for human rights in accordance with the Constitution or national law on the use of force.
This measure, approved by the Chamber of Deputies, allows the Mexican National Guard, for 10 years from the approval of the law on public security, effective from 2019, to have soldiers to perform public security tasks in “emergency, regulated, controlled, subordinate and complementary”, by order of the President of the country.
Armed forces on the streets
In August, López Obrador proposed that Mexican Navy soldiers and babies remain on the streets after 2024 to support the Mexican police in their public safety work, after he introduced a reform in 2019 that was limited to a maximum of 5 years. López Obrador had previously countered that “the public safety emergency facing the country” makes such an expansion necessary.
