The ministers note that Russia’s recent deliberate strikes on civilian homes, schools and playgrounds, as well as civilian infrastructure across Ukraine, are just the latest phase of Russia’s relentless terrorist campaign against the Ukrainian people.
“As Russia’s brutal attacks on Ukraine continue, the EU must act to ensure that seeking justice and accountability for Russia’s heinous crimes in Ukraine is at the heart of our policy,” the statement said .
Thus, the ministers added that the EU should continue to support the investigations conducted by Ukraine and several other states, as well as the International Criminal Court (ICC).
“At the moment, there is no international court or tribunal that can hold Russia’s top political and military leadership accountable for committing the crime of aggression against Ukraine. To fill this jurisdictional hole, it is necessary to create a special tribunal to punish the crime of aggression against Ukraine,” the statement said.
It was noted that the creation of a special tribunal would complement the role of the ICC. While the ICC prosecutes individuals for war crimes, genocide and crimes against humanity, the special tribunal’s primary responsibility is the crime of aggression.
“The main masterminds, instigators and facilitators of this deadly aggression cannot escape justice simply because of a gap in international criminal jurisdiction,” the statement added.
