President Volodymyr Zelensky promised to pay “every meter of lost real estate” in Ukraine. The procedure for payment of Ukrainians for damaged or lost housing has not been finally determined – the Verkhovna Rada is still finalizing the final version of the bill. Not money, but apartments
The draft law no. 7198 on compensation for damaged or destroyed housing was adopted by the Verkhovna Rada of Ukraine only on first reading, and people’s representatives submitted numerous comments and proposals to it for improvement. Therefore, a real mechanism for providing compensation to homeowners does not yet exist.
The draft law adopted on April 1 provides for the creation of a state register of assets damaged and destroyed by the war, as well as the procedure for compensation for it from the state.
The explanatory note states that the bill proposes to introduce compensation provision for certain categories of damaged and destroyed real estate.
This applies to owners of damaged or destroyed property and people; those who invest and finance the construction of housing construction projects; and those who bought an apartment or other residential premises of the cooperative, but did not formally own it.
The law also applies to the heirs of the above persons and associations of co-owners of apartment buildings, managers of apartment buildings, housing construction cooperatives (housing) that maintain their respective houses, to restore the damaged common property of an apartment building.
As explained by Elena Shulyak, chairman of the Servant of the People party, the bill would provide compensation not in money, but in new apartments or houses for victims.
“We hope that there will be such an opportunity when a person chooses for himself. For example, his apartment in the city of Kharkov is destroyed, he can choose another city. And vice versa – if an apartment in another city is destroyed, he can choose an apartment in Kharkov, “he said. at the All-Ukrainian telethon on April 14.
The People’s Deputy said the bill could be adopted on second reading and generally in April. He added that more than 70,000 applications for damaged or destroyed property have already been registered in the Diya application.
Compensation for housing lost by citizens during the war will begin to arrive in a few months. The state intends to buy the first apartments in prefabricated houses that have not yet been operated, Shulyak said.
However, some restrictions will be imposed on the right to own this housing: the owner will not be able to sell it for three years, the MP added.
“Because we want Ukrainians to stay in Ukraine, and not sell the housing received as a result of compensation and go abroad,” said Olena Shulyak, chairman of the Servant of the People party.
Compensation for housing was promised to all those who suffered from the war, but not immediately – the mandate would be established. First of all, new housing will be provided to the families of servicemen who fought for Ukraine, as well as to socially unprotected families: large families, as well as to those inhabited by people with disabilities.
What can and should be done now
The only thing owners of damaged or destroyed housing can do is report it to the state. This can be done regardless of the place of residence or stay using the Diya application or by contacting the Center for the Provision of Administrative Services (TSNAP) or a notary.
To file a claim for damaged property with Diya, you must:

Just enter data about your own housing. A person cannot apply for the whole house – just for their apartment. After the registration of the notice, information will be received on the commencement of the assessment and compensation procedure, to be determined by the government.
A similar application with all personal data can be personally submitted to TsNAP or a notary. It is necessary to bring documents proving your identity and rights to the destroyed property.

When recording video of damaged or destroyed property, lawyers recommend clearly stating: full name, passport details and, if possible, TIN.
“Name the date and time of the shot, but it is better to capture the video screen from another device, for example, a wristwatch, a mobile phone screen. The lawyer also recommends finding a photo or video of the property before it is destroyed. If there is information about this house or apartment in the media, links to these materials or stories should be maintained.
“Evidence from witnesses, if any, is equally important. If you know people who have witnessed damage or damage to your property, if possible, obtain written, audio or video evidence from them and save their contact details, ”Grishchenko said.
