The defense of Argentine Vice President Cristina Fernandez appealed to the “intervention” of political power and the role of the press and questioned the “impartiality” of the courts in her court filing that put her on trial for alleged corruption when she was president (2007-2015).
“After almost three years of hearings during which a lot of evidence was collected, it was shown that what was said in 2016 and even before is not credible, and that the evidence collected (during the trial) refutes any allegations, since of course they are false. and unreasonably”, said this Monday Carlos Beraldione of the vice president’s lawyers.
“Despite this, for nine days we heard a statement in which, forgetting everything that was proven in this trial, (formulated) the same accusations that have been made since 2008 and 2016,” Beraldi said of the prosecutor’s statement. .
The prosecutor’s office ended the debate on August 22 by issuing motion to sentence Cristina Fernandez to 12 years in prison and her disqualification from holding public office for crimes of unlawful association and fraudulent administration during her two terms in office.
Beraldi indicated that “unusual things” were heard, which were reported by the media in the sense that the testimony of the prosecutor was “irrefutable” and weighing 3 tons: “I have never heard such nonsense.”
Media and attack
Vice President Fernandez anticipated the start of her tech defense on Sunday by asking his followers on her Twitter account to “listen carefully as the scripted farce of prosecutors (Diego) Luciani and (Sergio) Mola is laid bare,” and ironically asked if the newspapers Clarín and La Nación were going to broadcast it.
The former president defended by posting a speech on her social media on August 23 in which she claimed that this oral process, which began in May 2019, is “trial of Peronism and national and popular governments”.
Fernandez accused prosecutors of using a media “script” linked to the current political opposition, saying that his sentence “has already been written” and returned to denounce “the law” (the prosecution).
Already this Monday, after the appearance of her lawyer, the vice president again declared herself on the same social network: “You saw what I told you yesterday, right? That Beraldi was going to deprive Luciani and Mola of the script. I’m getting better.” , it was much further: he documented – as it should be done in any court – that Luciani and Mola were blatantly lying. He, out of professional propriety, called it a malpractice.”
The vice president’s technical defense comes against the backdrop of the September 1 attack on the former head of state, from which she emerged unscathed and for which two people were prosecuted and two were detained.
The attack took place near the home of the vice president, in the Recoleta metropolitan area, during one of the demonstrations her supporters have been holding since. The prosecutor’s office requested a sentence for the ex-president.
Leaders close to Cristina Fernandez have linked the court case to the attack on the vice president and the lack of public peace.
“If we lose the central idea of the trial, which is to establish the facts, to assign responsibility and to fulfill the democratic function of restoring peace, then we are doing our country and ourselves a disservice,” Beraldi said on Monday.
lower arms
The defense phase that began on September 5 has continued this Monday with the vice president’s turn, and even that will be defended on Friday the 23rd.
Fernandez is on trial along with 12 other defendants for alleged violations of transfer of 51 public works to the firms of businessman Lázaro Báezclosest associate of former President Néstor Kirchner (2003-2007), in the southern province of Santa Cruz, a stronghold of Kirchnerism.
Cristina Fernandez’s lawyer pointed out this Monday that the decision would always have to be on file in order to “demonstrate by all existing legal instruments that the allegations are false” and stressed that all of his proposals were rejected.
“During these six years, we never once gave up, even when we had to put up with various unusual arbitrariness,” when the lawyer referred to the fact that she was called on the same day for eight investigative actions, and the offenses that were committed in progress”, which was also addressed to his daughter Florencia Kirchner.
