The charter of a special tribunal in the crime of aggression against Ukraine is ready. This was reported by Deputy Head of Presidential Office Irina Mudra on Facebook on Tuesday, June 24.
Now the document has been published on the European Council website. “This is a historic achievement not only for Ukraine, but also for the entire architecture of international law. A document that provides a real opportunity to bring justice to those who released this war,” Mudra emphasized.
The Deputy Chairman of the Presidential Office brought the major provisions of the Charter:
- There are no immunities for aggression. There is no mention of personal safety in the charter. Even the current leaders of the aggressive state – the so -called “Triple” – will not avoid responsibility: they will receive the accusation that the tribunal prosecutor will submit publicly and transfer them to the initial production judge. Convince and absentee are possible after the troika position left.
- Fully international jurisdiction. The tribunal will have an international legal personality, and not the status of a hybrid or national structure. It is an independent institution of international law, which will speak on behalf of the world with the language of international law.
- Aggression crime – clearly defined. The basis is Article 8 of the Roman Mus -Roman law, which is supplemented by the standard of aggressive war from resolving 3314 UN General Assembly. The concept is clear. Responsibility is inevitable.
- Mus cooperation, not competition. The special tribunal does not disturb the International Criminal Court – filling it. Production can be the same, and in the case of the Mus’s transfer – the tribunal process is suspended.
- Full -fledged writing processes. A separate achievement of Ukraine is the integration of the absentia mechanism. We are allowed to receive sentences even without the presence of accused (except for the current “three” until they are in positions) – especially against Russian political and military leadership (and also Potential Belarus and the DPRK).
- Legal establishment of fact. Creating a special tribunal is an opportunity for the first official international recognition of a crime of aggression from Russia since 2014. So as Nuremberg did.
Remember, on June 25, the president of Ukraine Volodymyr Zelensky and Secretary of the General Council of Europe Alain Berse will sign a Strasbourg agreement on the creation of a special tribunal to investigate the crime of invasion against Ukraine.
