Today, January 24, the Verkhovna Committee on National Security, Defense and Intelligence at his meeting examined the situation with accusations of individual troops of senior and senior officers of the Armed Forces.

The Committee considers it necessary to emphasize: in the context of the struggle with aggression armed with Russian statements and actions that can lead to discrediting the Armed Forces of Ukraine, pose a threat to the unity of our people and influence the protection of the state, the statement says.
The Committee emphasizes that on March 15, 2022, the Verkhovenna Rada of Ukraine adopted important changes in the current legislation, which provide for the introduction of martial law of the military immunity in the legal regime:
“Combat immunity is a legal fuse that excludes the criminal illegality of the law and provides for the possibility of reasonable dismissal of military personnel (in particular, representatives of the military command) from criminal liability for acts committed in martial law, primarily during the repulsion of armed aggression.
In view of this, the Committee unanimously made a decision in which its position:
- Recognizing the need for a thorough study of events that can lead to serious consequences and damage to the national security of the state, undoubtedly, in relation to the competence of the relevant law enforcement agencies, the Committee sees the decisions adopted by the application of the rules. The law is evidenced by the separation of certain events and certain persons and the timely legal assessment of other events and actions of other persons who have repeatedly indicated the committee in their decisions. According to the members of the committee, this approach can lead to a violation of the cornerstones of the equality of all to the law and the court, objectivity, impartiality and justice;
- According to the members of the committee, the use of excessively strict preventive measures for the current military personnel of the Armed Forces, active participants in military operations is disproportionate and can be based on an arbitrary interpretation of the rules of current legislation. According to the members of the committee, the demonstrative increase in officials and generals awarded state awards for participating in the reconciliation of armed aggression, establishing an excessive amount of the assembly of Ukraine.
- The committee members emphasize the need to avoid any statements or comments of officials or comments that are able to influence citizens with a false impression of investigated events, the premature idea of the guilt of military personnel, whose actions have not yet received a proper legal assessment of the court. Any manipulations or speculations on such a sensitive topic not only violate the constitutional principle of the presumption of innocence, but also able to contribute to the enemy’s efforts by the corrosion of the mutual trust of society and the armed forces.
The Committee will continue to monitor the situation of criminal prosecution of military personnel of the Armed Forces of Ukraine and other representatives of security and defense forces. At the next meeting, the Committee plans to listen to the information of the relevant profile authorities, which should lead to the relevant decision of the committee, the statement said.
