A judge has decided to dismiss a federal lawsuit about a politician’s influence on the results of the 2020 presidential election.
The federal case against newly elected President Donald Trump over his influence in the 2020 presidential election, which culminated in the attack on the Capitol, has been dismissed in the United States. ABC News reports.
Earlier in the day, US Department of Justice Special Prosecutor Jack Smith filed a petition with Judge Tanya Chutkan, in which he referred to the US Department of Justice’s policy of not prosecuting presidents for federal criminal offenses .
Smith believed that criminal prosecution of a sitting president would violate the US Constitution, undermining the ability of the nation’s chief executive to carry out his duties.
The judge responded by dismissing the case, leaving open the likely possibility that Trump could be prosecuted in the future.
Chutkan said closing the case would not harm the “public interest.” He agreed with Smith’s argument that once Trump leaves office, presidential immunity will not apply to him.
However, it is unlikely that any prosecutor will attempt to file the same charges in the future, as the statute of limitations for such crimes has expired.
As you know, last year Trump was charged with seven counts under the Espionage Act. It stems from the improper storage of classified documents at his Florida residence after he left the presidency in 2021.
