The government, by resolution of October 8, 2024 No. 1147, amended the Rules for the provision of postal services, equating the storage time of summonses from the TCC to court summonses.
Under these changes, men will have three days to pick up a registered letter sent by TCC from the post office. Otherwise, they will face a decision from the TCC on a fine of 17 to 25.5 thousand UAH, reports Judicial and Legal Newspaper.
The changes introduced by Resolution No. 1147 stipulate that recommended letters marked “TCC Summons”, when delivered to the specified address, are delivered personally to the addressee (recipient). The Cabinet of Ministers clarified that recommended letters marked “TCC Agenda” and “Deliver in person” must be delivered personally to the addressees.
If the addressee (recipient) is not at the address indicated on the registered letter, the employee of the postal service facility informs the addressee (recipient) at the available telephone number and/or puts a message in the subscriber’s mailbox about the receipt of a registered letter marked “TCC Summons”.
If within three working days after notification by the post office the addressee (recipient) does not appear to receive a registered letter marked “TCC Summons”, the employee of the postal service facility makes a note “the addressee is not at the specified address”, which is certified by his signature with a postal stamp. device, the procedure for using which is established by the designated postal operator, and no later than within the next working day returns such a letter to the sender.
In essence, this will be a “proper message”, after which the TCC may issue a fine, the publication notes.
In the event that the addressee (recipient) refuses to certify with his signature the fact of refusal to receive a registered letter marked “Court Summons”, “TCC Summons”, the employee of the postal service facility makes a note “Addressee refused” and no later than within the next business day returns to its sender.
If a registered letter marked “Court Summons” or “TCC Summons” is not delivered, such items, together with the return receipt form, are returned to the return address in the manner prescribed by these Rules, indicating the reason for non-delivery.
