Lists of “swindlers” discovered during searches in the office of the head of the Khmelnitsky Regional Medical and Social Expert Committee (MSEC) Tatyana Krupa have already been transferred to the State Bureau of Investigation (SBI).
The DBR promises to carefully study these documents. Men with a fictitious diagnosis may face 3 to 5 years in prison for evading mobilization. The investigation is ongoing.
As part of the pre-trial investigation, the State Bureau of Investigation is studying lists of “evaders” that were discovered during searches in the office of the head of the Khmelnitsky Regional Center for Medical and Social Expertise, Krupa. According to the department, their names and fictitious diagnoses were indicated,” said Ekaterina Gerasimuk, a representative of the regional department of the DBR in Khmelnitsky, in a commentary to Public Khmelnytsky.
The publication cites the conclusions of lawyer Natalya Svirnevskaya. She notes that those on the list must be found and checked by pre-trial investigation authorities.
It will be necessary to establish whether the diagnosis is correct or incorrect. During the interrogation, they must find out why the person applied to MSEC. You can check whether she has asked for such help before. If they prove that the diagnosis is incorrect, the questions will be investigated as to how they managed to find people who agreed to establish it,” the lawyer noted.
Svirnevskaya explained that if it is proven that a person on the list has an incorrect diagnosis established for the purpose of evading mobilization, he may face liability under Article 336 of the Criminal Code of Ukraine. The sanction of the article provides for punishment in the form of imprisonment from three to five years.
The lawyer said that if the pre-trial investigation authorities establish that, in addition, money was provided to obtain a diagnosis that would give grounds for a deferment or not to serve in the Armed Forces of Ukraine, then such actions can be qualified under Article 369 of the Criminal Code of Ukraine . The sanction of the article provides for punishment in the form of a fine of up to four thousand tax-free minimum incomes of citizens or restriction of freedom for a term of two to four years, or imprisonment for a term of five to ten years with or without confiscation of property.
They will find out whether they were forced to take it, or whether they offered it themselves. Not only qualifications, but also the punishment will depend on this,” Svirnevskaya explained.
