The Economic Court of the Ivano-Frankivsk region ordered Tekh-Engineering LLC to pay UAH 2.82 million in penalties in favor of a military unit for failure to repair a fence in the city of Kolomyia. This is confirmed by the text of the court’s decision.
A military unit in the Ivano-Frankivsk region ordered the current repair of the fence of the military camp for UAH 6.27 million. The fence must be repaired by December 15, 2023.
However, the contractor did not start the repairs. Tech-Engineering wants to extend the contract. The military unit plans to terminate the contract early and demand payment of fines and penalties.
The parties did not agree to extend the contract or terminate it early. As a result, the prosecutor’s office filed a claim for the recovery of UAH 2.82 million in penalties and fines, as well as for the termination of the agreement.
At the court hearing, the private company called for a 90% reduction in the amount of fines. The request is motivated by the absence of harm caused and honest behavior.
The court rejected the petition, because the reduction of the amount of penalties and fines by 90% neutralizes the purpose of the penalty as civil liability for the violation of an obligation, which can be considered as an avoidance of responsibility and will lead to an imbalance of interest of the parties.
The court collected UAH 2.82 million in penalties from the LLC, of which UAH 2.5 million were penalties and UAH 313.5 thousand were fines.
However, claims for termination of the contract between the military unit and the private company were not satisfied.
