The building at 22 Konissky Street was seized back in January of this year, with a ban on use, disposal, and alienation, as part of a case on the intentional illegal destruction, demolition, or damage to cultural heritage sites. The Office of the Prosecutor General reported this on Telegram on July 21.
The prosecutors petitioned for the seizure of the building. The OGP explained that according to the general plan of Kyiv, this site is within the boundaries of the historical area of the capital. And permission from the Ministry of Culture is needed to carry out construction work.
Despite this, construction work, including capital construction, was carried out there for a long time. The prosecutor’s office points out that construction work was carried out without the appropriate approval of the ministry, therefore all work must be stopped, the department noted.
It is noted that, despite the imposed arrest, on July 19, unknown persons destroyed the Zelensky estate using construction equipment. The actions of the perpetrators were qualified as the destruction of property that was subject to arrest – Part 1 of Article 388 of the Criminal Code of Ukraine. And the continuation of construction despite the imposed ban was qualified as unauthorized construction on an illegally occupied land plot – Part 3 of Article 197-1 of the Criminal Code of Ukraine.
Investigators located the equipment that was used to demolish the building. They conducted an immediate search there and seized the equipment.
Let us recall that on May 19, in the center of Kyiv on Konissky Street, the Zelensky estate was demolished – a historical building built in 1890. The Department of Cultural Heritage Protection of the Kyiv City State Administration called the situation with the demolition of the estate “impudent and cynical arbitrariness.”
