The Ministry of Foreign Affairs website published answers to “Common questions about time restrictions in accepting new applications for consular services.”
The diplomats recalled that the adopted and signed Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine on Certain Issues of Military Service, Mobilization and Military Registration” will come into force on May 18, 2024.
These circumstances created the need to make technical changes to the algorithms of the information and communication systems of the Ministry of Foreign Affairs, which are used to perform relevant consular functions.
The Ministry of Foreign Affairs announced a temporary cessation of accepting new applications for consular actions from this category of Ukrainian citizens from April 23 of this year (with the exception of applications for issuing identity cards for returning to Ukraine).
The decision to suspend the process of providing consular services to a category of Ukrainian citizens defined by law is a temporary step, due to the need to resolve issues of military registration of citizens of mobilization age who are abroad, and to resolve, in cooperation with other involved government bodies, technical issues that have arisen in the implementation of the norms and provisions of the mentioned law,” says the Ministry of Foreign Affairs website.
Temporarily, only new applications from the category of citizens defined in the new law will not be accepted, since the period for consideration of such applications may exceed the time remaining before entry into force.
We strive to protect citizens from situations where the ordered service cannot ultimately be provided, the Foreign Ministry assures.
The changes do not apply to men applying for services for their children.
After “On Amendments to Certain Legislative Acts of Ukraine on Certain Issues of Military Service, Mobilization and Military Registration” comes into force on May 18, 2024, the process of accepting and considering applications for consular actions will continue taking into account the new requirements arising from the provisions of the law.
The Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine on Certain Issues of Military Service, Mobilization and Military Registration,” which will come into force on May 18, 2024, provides that after updating the military registration data in the TCC, a male citizen of Ukraine aged from 18 to 60 years of age with valid military registration documents will have full access to consular services in accordance with the law.
The mechanism for updating and verifying military records for men 18-60 years of age temporarily stationed abroad is currently being determined from the available options and agreed upon by the government agencies involved. Once this interdepartmental work is completed, diplomatic agencies and the Ministry of Foreign Affairs will publish further detailed clarifications.
Temporary restrictions do not in any way affect the provision of consular assistance in case of emergency situations with Ukrainian citizens abroad. They relate only to the submission by a certain category of citizens of applications for certain consular services during a certain period. If any citizen of Ukraine finds himself in an emergency situation abroad (road accident, detention, natural disasters, etc.), consular service employees will provide the necessary consular assistance in full within the framework of the law.
The Ministry of Foreign Affairs has long been charged with maintaining military records. The corresponding functions of foreign diplomatic institutions were determined by a resolution of the Cabinet of Ministers of Ukraine dated December 7, 2016.
At the same time, at that time the legislation was developed taking into account the realities of that time. After the migration wave of 2022, provoked by the escalation of Russian aggression, the mechanisms of military registration work laid down by law needed fundamental changes, which were partially resolved by the resolution of the Cabinet of Ministers of December 30, 2022. The relevant regulatory and legal documents also required updating, as the Ministry of Foreign Affairs explained the adoption of the temporary ban.
