Agenda and restrictions for men abroad: what is known

Issuance of documents at consular offices abroad is suspended for Ukrainian men of military age.

The provision of consular services to Ukrainian citizens liable for military service currently abroad is suspended as of today. This information was confirmed by Ukrainian diplomatic institutions in Poland, Spain and China, they said it was done “on instructions from the Ministry of Foreign Affairs of Ukraine.”

Foreign Minister Dmitry Kuleba responded to the situation and explained that such a decision from Kyiv really exists and meets “the conditions of the current time and is fair.”

New restrictions

Yesterday, the media published a copy of the order of the Ministry of Foreign Affairs for the heads of all diplomatic institutions of our country on the temporary suspension of all consular actions related to citizens of Ukraine of military age .

Today, the Ukrainian consulate in Poland, Barcelona and the Ukrainian embassy in China confirmed the authenticity of the order of the Ministry of Foreign Affairs and suspended the provision of services to men of military age – from 18 to 60 years.

“We are waiting for instructions from the Ministry of Foreign Affairs Now their reception is temporarily suspended Now the mechanisms in accordance with the mobilization law,” an employee of the consulate in Poland told the Public.

In addition, foreign divisions of the State Enterprise Document have also suspended work. It was reported on the department’s website, but they assured that it happened for “technical reasons.”

At the same time, the Ukrainian consulate in Hamburg, in a mailing sent to refugees in Germany, reported that it will continue to issue previously issued passports to men of military age, despite the order of Ukrainian Foreign Ministry, but stated that the new documents from the men will not actually be accepted.

What consular actions are we talking about?

The list of issues dealt with by consulates is specified in the Consular Charter of Ukraine. In particular, they are:

  • Issuing foreign passports and extending their validity, making changes to them;

  • Carrying out instructions from investigative or judicial authorities;

  • Conclusion and dissolution of marriage;

  • The consulate can accept for storage money, valuables, papers and documents belonging to citizens of Ukraine.

  • In the case of detention of Ukrainian citizens or other measures restricting freedom, the consulate must ensure that the rights and interests of Ukrainian citizens are not limited.

Consulates also establish paternity (if the parents live in the consular district and at least one is a citizen of Ukraine), guardianship and trust, and register acts of civil status.

In addition to this, consulates conduct notaries, in particular:

– evidenced by contracts, wills, instructions
– issue certificates of inheritance rights
– issue certificates of ownership of part of the common property in marriage
– certified copies, copies of documents and extracts from them
– verify the authenticity of signatures on documents
– verify the authenticity of the electronic signature on electronic documents
– ensure translation from one language to another
– establish the fact that the individual is alive
– indicate the fact that an individual is in a certain place
– show the identity of the photos
– record the time of submission of documents
– published duplicate documents.

This means that all of these services for military age men who are overseas are not available.

Explanation from the Ministry of Foreign Affairs

The Ministry of Foreign Affairs of Ukraine issued an official statement on this situation. They report that the Ministry of Foreign Affairs will soon explain the procedure for obtaining consular services for men of mobilization age abroad.

“What does it look like now: a man of military age goes abroad, shows his state that the question of his safety is not bypassed, and then comes and wants to receive services from this state. It doesn’t work that way. There is a war in our country“- said the head of the Ministry of Foreign Affairs Dmitry Kuleba.

According to him, the obligation to update their TCC documents existed even before the new mobilization law was adopted.

“If these people believe that someone there, far from the front, is fighting and giving their life for this state, and someone will sit in another country, but at the same time will receive services from this state – that’s not how it works,” – wrote the minister.

He noted that staying abroad does not relieve a citizen of his duties in Ukraine.

“That is why yesterday I ordered the measures to be taken to restore fair treatment of men of mobilization age in Ukraine and abroad. It will be fair,” said Kuleba.

What’s on the agenda?

Earlier, Fyodor Venislavsky, a member of the Verkhovna Rada Committee on National Security, Defense and Intelligence, explained that the new mobilization law will oblige men abroad to update their data in electronic accounts, but they will not receive summonses.

“We left the opportunity, first of all, for people living outside Ukraine to use the electronic account to remotely update data without entering the territory of Ukraine, since then there will be a problem with the possibility of their -leave,” said Venislavsky.
