Elections during martial law in Ukraine are prohibited by law. And in order to elect a new president, the election must be held.
During martial law, the powers of the President of Ukraine cannot be terminated. This was stated in the Central Election Commission’s response to the Commander-in-Chief’s request regarding the expiration of President Vladimir Zelensky’s constitutional powers and the effect of martial law in the country, Ukrinform reports.
“The Basic Law of Ukraine establishes the procedure for the organization and exercise of state power to ensure the continuity of its implementation. First of all, it applies to the Verkhovna Rada, the President, and the Cabinet of Ministers. in the Constitution, the President exercises his powers until the newly elected President resumes the position. The President of Ukraine cannot transfer his powers to another person or body,” the CEC stated in its response.
The CEC explained that the performance of presidential duties can be entrusted to the chairman of the Verkhovna Rada only in cases of early resignation of the head of state and for the period of election and tenure of a new president.
At the same time, the CEC said that since February 24, 2022, martial law continued in Ukraine, and according to the Constitution, in the conditions of martial law or a state of emergency, certain restrictions on rights and freedoms were established. In particular, under martial law, the holding of national and local elections is prohibited.
The Martial Law Legal Regime Act states that the powers of the president cannot be terminated during martial law, and if the president’s term of office ends during martial law, his power will continue until the newly elected president will then be elected. the lifting of martial law is in effect.
The CEC also explained that the decision to call elections, whose electoral process has not yet begun due to the introduction of martial law, was made by the relevant subject of their appointment not later than one month from date of termination or cancellation of martial. law Calling presidential elections is within the powers of the Verkhovna Rada.
We remind you that the next parliamentary elections in Ukraine will be held in October 2023, and presidential elections in the spring of 2024. However, the martial law regime makes it impossible to hold elections.
