The official position of the Ministry of Justice is that you cannot be sent to the front for certain categories of crimes. But the minister also has a personal opinion.
People with criminal records, but released from prison on “safe” charges, should be mobilized. In particular, it applies to corrupt officials and traffic violators. This is what Minister of Justice Denis Malyuska said in an interview RBC-Ukraine.
“It’s interesting to start not with convicts, but with those who have a criminal record. These are people who have left prison, or have never been there. According to the law, they cannot be mobilized. That is, people with a criminal record are not subject to military registration. Actually, this is the simplest and most obvious thing that needs to be corrected. There is no question of danger for people, they are walking on the street, talking to us. I don’t understand why they don’t they join the army and fulfill their duty to defend the Motherland.
According to him, he does not understand why people in prison, who are not dangerous to society, are convicted of a non-violent crime, why they have immunity and do not serve in the army, although there is such a need, especially. because there are many military commanders willing to take them.
“All we are talking about is giving the TCC the right to take such things. They will take them and see if there is something suitable, something not suitable, it is up to the TCC to decide. But since the beginning of the war, we have had an interest the military and intelligence even among those convicted of serious crimes, for violence. In other words, those who know how to kill, they are interested in some special operations,” explained Malyuska.
The minister believes that “road accident workers” should also be mobilized.
“Accordingly, there is usually little difference between a traffic violator who is in prison by court sentence, and one who is not in prison, but limits himself to a fine, or pays nothing, even that a fine is not imposed. From the point of view of purpose and danger to society they are the same people, but some are in prison and others are not. And, accordingly, from this point of view , I see no danger to the public in mobilizing the same “road accident officers” and sending them to fight. They are the same citizens as us,” the head of the Ministry of Justice noted.
According to him, the official position of the Ministry of Justice is that for some categories of crimes can not be sent to the front.
However, the minister believes that in a complex war it is necessary to give the military and military intelligence the right to choose whomever they want.
“But this position, unfortunately, is unlikely to have prospects of support in parliament, so we have not broadcast it as the official position of the ministry,” he said.
We remind you that the police say that a suspended sentence does not save draft dodgers from mobilization.
