According to ZN.UA, the president’s office prepared the text of the appeal taking into account the fact that on May 20, 2024, the five-year period specified by the Constitution of Ukraine (Part 1 of Article 103) from the inauguration of the president expires. The OP still hasn’t decided what to do with the appeal, because they are afraid of not getting the right decision.
The President’s Office is actively working to resolve the issue of how to proceed from the situation that will arise after May 20. One of the options that the President’s Office is considering is an appeal to the Constitutional Court with a submission regarding the official interpretation of the provisions of the Constitution that regulate the holding of the next presidential elections and the five-year term of office of the President.
As sources told ZN.UA, they want to ask several questions to the Constitutional Court.
First: whether the Constitution allows for presidential elections to be held under martial law. The Constitutional Court’s answer to this question should clarify the constitutionality of the ban on holding elections under martial law, which is provided for by the Electoral Code and the law on martial law.
The second question for the OP is more important and concerns the legitimacy of the powers of the president after the expiration of the five-year term in office, that is, after May 20.
According to the plan of the leadership of the OP, if a decision is made to appeal to the Constitutional Court with such a constitutional submission, then this will be done by people’s deputies from the Servant of the People. But the appeal has not yet been transmitted to the deputies of the presidential faction themselves.
However, as of today, no final decision has been made regarding the advisability of such a constitutional representation. According to ZN.UA, many in the president’s team consider this appeal to the Constitutional Court to be belated. But the main limiting factor is that the OP is not confident that they will receive a quick, and most importantly, the solution they need from the CSU. In 2024, President Zelensky will lose legitimacy.
