There is until February 21 to introduce the amendments, after which there will be a vote on the second reading.
“That is, the bill as a whole is likely to be adopted in the last week of February, which was signed in early March and will take effect in one month, that is, in April,” predicts people’s deputy Yaroslav Zheleznyak.
Violations of the Constitution
Verkhovna Rada Commissioner for Human Rights Dmitry Lubinets was among those who called for the bill to be adopted in the first reading. At the same time, according to him, the draft contains a number of standards that contradict the Constitution of Ukraine. The Ombudsman hopes that these contradictions will be eliminated in the second reading.
In particular, he drew attention to the fact that the bill states that the military order can establish a temporary restriction on the right of a Ukrainian citizen to leave the country. And according to the requirements of Article 17 of the Constitution of Ukraine, the Armed Forces of Ukraine and other military formations cannot be used by anyone to restrict the rights and freedoms of citizens.
In addition, the bill proposes to provide an obligation to register the electronic account of a conscript, a person liable for military service, or a reservist, for non-compliance with which the latter has legal responsibility as defined of the law. However, the provision of this bill does not comply with the provisions of the Constitution, the Law of Ukraine “On Protection of Personal Data” and “the legal positions of the Constitutional Court of Ukraine regarding the official interpretation of the right to personal and family life.”
Graduate students ask
The new changes also indicate the removal of the right to exemption from conscription for military service during mobilization for a special period of graduate students receiving a degree of education at the expense of individuals or legal entities on a contractual basis.
“At the same time, all other categories of education seekers in these conditions retain the right to be exempt from conscription. This contradicts the requirements of Article 24 of the Constitution of Ukraine regarding the equality of citizens’ rights and the avoidance of discrimination on some grounds,” emphasized Lubinets.
An electronic petition has been created on the president’s website, asking to remove from the bill the provision for mobilizing graduate students studying on a contract basis and leaving them the right to deferment, which still valid today.
