Former US President Donald Trump on Wednesday, January 3, filed an appeal with the Supreme Court against Colorado’s decision to disqualify him from the state’s Republican Party primaries, The Hill reports.
The publication notes that the appeal will likely involve a major battle at the nation’s highest court, which has never ruled on the Third Section of the 14th Amendment. This clause, added after the Civil War, barred anyone who had sworn to support the US Constitution but participated in rebellion against it from holding federal office.
The Colorado Supreme Court ruled in December that Trump had engaged in insurrection by inciting his supporters with false claims of election fraud after the 2020 race and marching them on the Capitol on Jan. 6. and therefore he was barred from participating in the primaries. The state’s highest court also reversed a trial judge’s finding that the 14th Amendment did not apply to the president, emphasizing that the words of the presidential oath of office “mean nothing more than an obligation to uphold the Constitution.”
At the same time, the Colorado court delayed its decision until next Thursday so that Trump could appeal to the Supreme Court. If he agrees to hear the case, the decision will be delayed until the judges decide on the merits.
However, the Supreme Court is unlikely to hear Trump’s appeal before Friday, the end of Colorado’s presidential primary. He will likely participate in the primary election.
