The head of state agreed on bill No. 9185, which provides for the introduction of probation supervision. Probationary observation involves a comprehensive influence on the offender without isolation from society. Such punishment can be imposed for a period of one to five years (one to two years for minors). This was reported on the website of the Verkhovna Rada of Ukraine.
The bill provides that punishment in the form of probation supervision will consist of restricting the rights and freedoms of the convicted person, defined by law and established by a court verdict, with the use of supervisory and social-educational measures without isolation from society.
This type of punishment will be an alternative to restriction of freedom. The draft law proposed replacing criminal punishment in the form of arrest (except for criminal offenses committed by military personnel) with probation supervision. This also does not apply to people who have committed serious crimes.
The Ministry of Justice reported that the introduction of probation supervision will contribute to the humanization of the penitentiary system and expand opportunities for personal correction. It will also make it possible to implement the recommendations of the ECHR on the need to optimize the penitentiary system and reduce the number of convicts.
A convict who is under probation supervision will be required to periodically appear for registration, report changes in place of residence, work or study, and not travel outside of Ukraine without the consent of the authorized probation agency.
He may also be forced to use an electronic bracelet, get a job at the direction of the authorized probation body, undergo treatment for drug and alcohol addiction, mental and behavioral disorders due to the use of psychoactive substances or illness.
Let us remind you that a military police may appear in Ukraine, which will become a military formation with law enforcement functions and will be part of the Ministry of Defense system.
