The KSU carried out the verification of agreements in Kharkiv

This decision was made by the second college of judges of the Second Senate in appeal to the constitution of 49 representatives of the people.

The Constitutional Court of Ukraine (CCU) opened proceedings on the constitutionality of the so-called Kharkiv agreements, which were signed in 2010 and authorized the Black Sea Fleet of the Russian Federation to be based in Crimea until 2042. The press service of the court reported this on Friday, April 14.

It is indicated that the corresponding decision was made on April 13 by the second collegium of judges of the Second Senate on the constitutional appeal of the 49 People’s Deputies of Ukraine.

“The subject of the right to a constitutional appeal argues that the incompatibility of the challenged Agreement “with the principles of ensuring national security, the lack of a legal framework for the conclusion of an international agreement of such content, as well that also the inconsistency of the said agreement with Article 17 of the Basic Law of Ukraine” is the basis for recognition of this Agreement as unconstitutional”, – told KSU.

It was indicated that in one of the meetings the Grand Chamber of the Court will determine the form of the constitutional proceedings in this case. The judge-rapporteur in the case is Sergey Golovaty.

Recall that law enforcement officials are investigating former Ukrainian leaders in connection with the Kharkiv agreements. In December 2022, a special investigation was completed against former President Viktor Yanukovych and former Prime Minister Mykola Azarov in this case.

The court also authorized the arrest of ex-Minister of Defense Mikhail Yezhel in connection with the Kharkiv agreements.
