Taras Kremen, Commissioner for the Protection of the State Language, believes that the Law on Media, adopted today, March 31, will strengthen the position of the Ukrainian language in this area.

“Important from the point of view of protecting the rights of citizens to receive information in the state language are the new things about the meaning of a Ukrainian-language program and film,” the Ombudsman said in a statement.

In particular, from March 31, a program will be considered Ukrainian if the speeches (remarks) of the hosts (announcers) of the program, people participating in the program are performed, translated using simultaneous or consecutive translation, dubbed, voiced (taking into account the requirements of the law) in Ukrainian .

Exceptions apply only to vernaculars, short replicas and reporting speeches from the scene, spontaneous live replicas (their duration cannot exceed 10% of the broadcast duration), songs , clips, short excerpts of copyrighted material.

In addition, temporarily until July 17, 2024, the use of a non-state language in speeches, interviews, comments, explanations, questions (announcers) of the program is allowed on the live air of the Ukrainian-language program to the extent that referred to. through the creative concept of the program.

The law removed the inconsistencies in various legislative acts on the definition of a film in the state language.

From March 31, the film will be considered produced in the state language if the sound sequence during its display (distribution) is produced, dubbed, dubbed in the state language.

“For the purpose of realizing an artistic, creative idea, it is allowed in a film (except for children and animated films) to use other languages ​​in an amount not exceeding 10% of the total duration of all replicas of the film’s participants, while all foreign-language replicas are subtitled in the state language,” Kremen wrote.

According to the new law, the minimum share of the Ukrainian language on national television will increase from 75% to 90% from January 1, 2024.

“One of the important standards in the language of the law “On Media” is part 6 of article 40 of the law. It is he who establishes clear requirements for calculating the share of programs created in the state language,” said the report .

Advertising information will not be taken into account when calculating the language quotas established by law on the air of audiovisual media.

“The exclusion of advertising from the calculation of language quotas on radio and television is our main requirement, because, in accordance with the Advertising Law, the language of advertising is a priori the language of the state. Accounting for advertising when considering- consider that part of the programs leads to the reduction of the share of the Ukrainian language in the television and radio space,” considered the language ombudsman.

As a reminder, on March 31, the Media Law went into effect.
