Oklahoma court approves abortion to preserve mother’s life

OKLAHOMA CITY (AP) — A divided Oklahoma Supreme Court on Tuesday struck down part of a nearly total abortion ban, ruling that women have the right to abortions when the pregnancy endangers their health, not just in cases of medical emergency .

It’s been a narrow victory for abortion rights advocates since the US Supreme Court overturned Roe v. Wade.

The court ruled that a woman has the right under the state Constitution to receive an abortion to preserve her life if her doctor determines that continuing the pregnancy would endanger her because of a medical condition she has or may develop during pregnancy. the pregnancy. Previously, the right to abortion could only take place in the event of a medical emergency.

The court, however, declined to rule on whether the state constitution grants the right to abortion for other reasons.

The court voted 5 to 4 to decide the lawsuit filed by Planned Parenthood and others challenging state laws enacted after the U.S. Supreme Court struck down Roe v. Wade legalizing abortion.

“People’s lives have been put at risk by Oklahoma’s cruel abortion bans, and now doctors will be able to help pregnant women whose lives they feel are in danger,” said Nancy Northup, president and CEO of the Center for Reproductive Rights. according to the government. “We are disappointed that the court declined to decide whether the state constitution also protects the right to abortion outside of these circumstances.”
