The National Bank of Ukraine (NBU) obliged banks during their activities to identify and document information about the ties of clients and their counterparties with the aggressor country.

The categories of clients for which the bank is obliged to detect and document such information, and the amount of relevant information for each category, have been determined.
It is noted that now the NBU has the right to apply to the bank with a separate request to obtain information about the ties of clients and their counterparties discovered by the bank with the aggressor state.
The collection and documentation of this information will help increase transparency in relation to bank customers with ties to the aggressor state, and reveal the hidden presence of the aggressor state in the Ukrainian market, the NBU notes.
The National Bank notes that these requirements were approved by the Resolution of the NBU Board dated March 16, 2023 No. 26 “On Disclosure of Information on Clients’ Relationships with the State Carrying out Armed Aggression against Ukraine”, which comes into force from the day following the day of its official publication .
According to the text of this resolution, banks must collect information about customers who:
- are citizens of Russia;
- are members of joint-stock companies established in Russia or whose shareholders and clients are the aggressor state or its citizens;
- have business relations with citizens and residents of Russia, as well as companies in the aggressor country;
- have subsidiaries, branches, representative offices in Russia;
- own securities of companies established in Russia.
It is noted that the NBU resolution applies to both Ukrainian banks and branches of foreign banks in Ukraine.
