Rada has optimized labor relations

An additional basis for dismissal of an employee was introduced, as well as a special procedure for such dismissal.

Parliament passed a law on optimizing labor relations under martial law. The document expands the grounds for dismissal of workers during the war. This is stated in the draft law No. 7251.

An additional reason for dismissal of an employee was introduced – the inability to provide working conditions due to property damage as a result of disputes, and a special procedure for dismissal of such employees was introduced. din.

In addition, an additional basis for termination of an employment contract was introduced, since the absence of an employee from work and information about the reasons for such absence of more than four months.

The law also defines the concept of part-time employment, which will provide an opportunity for employees forced to leave their jobs to find employment in another job.

For the martial law period, certain restrictions imposed by law in the field of anti-corruption regarding interaction with other fees or business activities were canceled.

At the time of the declaration of martial law or a state of emergency, all notices and documents on labor relations, orders (instructions) of the owner or a body authorized by him may be kept in electronic form .

It was noted that in order to eliminate legal uncertainties and overcome practical gaps in law enforcement, the law amends Law No. 2136-IX. Thus, the document defined the procedure for regulating working hours and 4 hours of rest during the war, in particular, in relation to the categories of workers who may have an increase in the duration of work in during the week, the mechanism for payment for work on a day off is restored, the procedure for granting annual primary leave. It also focuses on the fact that the introduction of additional working hours is the right, not the obligation of the employer.

In addition, it provides compensation to employees and employers of labor-related monetary amounts lost as a result of armed aggression.
