The panel of judges of the VAKS approved the plea agreement concluded between the prosecutor of the Specialized Anti-Corruption Prosecutor’s Office and the Poltava mayor Oleksandr Mamay. This was reported by the SAP press service on Thursday, March 2.
“According to the above agreement, the court found the mayor guilty of organizing the embezzlement of property by abusing his official position, as well as organizing the introduction of deliberately false information to official documents, which ultimately caused more than 570 thousand UAH of damage to the local budget, that is, of committing crimes, stipulated for Part 3 of Article 27, Part 4 of Article 191 and Part 3 of Article 28, Part 1 of Article 366 of the Criminal Code of Ukraine,” the statement said.
It is indicated that within the framework of the investigation before the trial, it was established that the mayor, in connivance with the director and accountant of the municipal organization Institute for the Development of the City, hired two people who actually did not work in the business, but carried out of housekeeping in the mayor’s house and his close circle.
“In order to pay salaries to the indicated persons, the officials of the municipal organization entered inaccurate information in the timesheets, which ultimately led to the work of the local budget for more than half a million hryvnias in losses, ” said SAP.
Due to the fact that the mayor of the city paid the damage, fully admitted his guilt and sincerely repented, the court sentenced him to five years in prison with the deprivation of the right to hold positions related to the organization and administrative or administrative duties for a period of 1 year. On the basis of Article 75 of the Criminal Code of Ukraine, the court released the person from punishment with a probationary period of 1 year.
“In addition, under the terms of the agreement, the mayor undertakes to transfer UAH 2 million to the United 24 Fund for a joint project of the General Staff of the Armed Forces of Ukraine, the State Special Communications Service and the Ministry of Digital Transformation. – the Army of Drones,” said anti-corruption activists.
The other defendants in this case, the two perpetrators and two accomplices in the embezzlement, also pleaded guilty and entered into plea agreements, which were also approved by the court.
“According to the agreement, they were sentenced to five years in prison with a probationary period of 1 year and deprivation of the right to hold positions related to the organization, administrative or administrative duties for 1 year. The sentence was may be appealed within 30 days from the date of its announcement by filing an appeal with the Appeals Chamber of the VAKS,” SAP summarized.
It will be remembered that on December 29, 2022, the mayor of Poltava was informed on suspicion of unauthorized dissemination of information about the deployment of units of the Armed Forces of Ukraine.
In January, the Kyiv District Court of Poltava refused to restrict the freedom of Alexander Mamai, obliging him to face every request of the investigator and prosecutor in the criminal proceedings.
Later, the court refused to remove the mayor from office.
