Russia calls for genocide of Ukrainians – PACE resolution

The Convention on the Prevention and Punishment of the Crime of Genocide of 1948, to which both Ukraine and the Russian Federation are parties, prohibits direct and public incitement to commit genocide and attempted genocide, PACE reminds.

The resolution also mentions a “possible genocide” in Ukraine. In particular, the text refers to the aggressive war of the Russian Federation against Ukraine and “atrocities arising from it (war crimes, crimes against humanity and possible genocide)”.

It contains the provision that the creation of an international special tribunal for the crime of aggression against Ukraine should not affect “the latter’s exercise of jurisdiction over war crimes, crimes against humanity and possible genocide committed in context of prolonged aggression.”

The document also mentions the existence of international and national mechanisms to investigate, prosecute and, if necessary, “punish war crimes, crimes against humanity and possible genocide committed during the ongoing war. “

PACE reminded that all states party to the Genocide Convention “have an obligation to punish genocide”.

“According to the interpretation of the International Court of Justice, they are also obliged to prevent genocide and have a corresponding duty to act, which arises as soon as the state knows or should be aware of the existence of a serious threat of genocide,” the document said. .
