Yurela Juncor, professor of law at the Autonomous University of Peru, stressed the importance of reconciliation before divorce.
In the “Family and Justice” sequence, the specialist pointed out that, for example, in reconciliation by mutual consent, when the parties before the divorce are the main actors, both can decide the dating regime in the presence of minor children, the distribution of material wealth, and also how the termination of the family connection.
He argued that the couple should try to reconcile, since a mutually agreed divorce can only last three months, since it can be carried out in the municipality or with a notary, but they must take into account that they will be asked for a reconciliation act as a precondition.
On the other hand, divorce, if it comes to court, can be extended for two years or more, when one of the parties does not agree, then the matter becomes more complicated.
“We have a divorce by mutual agreement, which is the best solution and procedural protection we can have, and the other one is a divorce on the grounds that one of the spouses does not want to get a divorce,” lawyer Yurela Junkor told Family and Fair RPP sequence.
Dr. Yunkor added that according to the Civil Code, both separation and divorce are subject to the same grounds, such as incompatibility of characters.
The specialist pointed out that the main reasons for divorce are infidelity, physical violence and irreconcilable situations, but it can only begin after two years of marriage.
When commenting, in case one of the parties who want a divorce is out of the country, what can be done is to request an immigration report that shows they live abroad, request consular representation and if they cannot be found or do not have the Will To get a divorce, a procedural guardian must be appointed representing one of the parties who does not want to get a divorce, is out of the country, or does not want to appear in the process.
