In the Family and Justice RPP sequence, family lawyer Lorena Meza raised the issue of the duties and rights of grandchildren towards their grandparents and whether there is an obligation to pay child support to them.
The specialist pointed out that there is no rule that directly indicates the obligations of grandchildren in relation to grandparents, but in the Civil Code, in the chapter where the issue of nutrition is considered, it is indicated that when a person needs food, the first debtor is the spouse, which means that if a grandfather or grandmother is married, then the husband or wife is the first person to provide food.
Dr. Lorena Meza explained that if a spouse is economically incapable or absent, then the next debtors will be descendants. “Children will be the closest, but if they are not able or absent only at this moment, grandchildren who have reached the age of majority and work will be used,” he said.
The specialist stated that in case of incapacity or absence for any reason of a spouse or children, only in this case the grandchildren can be held liable for collecting alimony in favor of a grandfather or grandmother who is in a situation of helplessness and needs support for their existence.
