Family lawyer Lorena Fernandez explained that there are several ways to request or claim an inheritance, which effectively consists of all assets, including the duties and rights of the person who dies in this case.
In the RPP sequence “Family and Justice”, the lawyer clarified that there are cases where the inheritance is the will of the testator who leaves property or property to a certain someone, but there are other cases when he dies without leaving a will, i.e., without leaving his said inheritance.
The specialist noted that there are two main ways to apply for an inheritance, but the most common is that the deceased left a will in which he expresses his desire to allocate his property or rights to certain relatives or friends.
In addition, he argued that there was a possibility that a person would die intestate, that is, that he would lose his life from one moment to the next, in which case the relatives must make an inheritance by will in order to determine the state and amount of property that the deceased left during his lifetime.
In the “Family and Justice” sequence, he also indicated that in the case of minors or people with mental disabilities who become heirs, they will not be able to manage their assets.
“In this case, there is a process for convening a family council to evaluate which family member is most suitable to manage the assets of minors or persons with any mental disability, and there is another process to determine whether the assets are sold or let in rent in accordance with the decision of the judge,” he added.
Fernandez’s lawyer argued that in this case, the family law judge must determine who is the most suitable family member to carry out all these procedures.
Finally, he suggested that it is always convenient to have a will to carry out the will of the deceased, since an inheritance can be accepted or rejected, since when someone accepts an inheritance, he does so in full with debts, dues and property. what could have been the dead person.
