family lawyer Lorraine Fernandez warned that if a father or mother is restricted or unable to communicate normally with their child, they may request a conciliatory or judicial visitation regime.

In the episode “Family and Justice” of the RPP, he explained that, unfortunately, in many cases, for no reason, the parent who has custody prevents the other from treating the child, either because the relationship between them ended abruptly, because the pension is not enough or because he doesn’t like his new partner. “There are many reasons why a custodial parent does not allow contact,” he noted.

At the same time, the specialist stated that the rule states that a father or mother who is prevented or restricted in the right to visit a child can apply for a visiting regime, since if the process cannot be carried out naturally, the law allows this disabled father or mother to demand .

He argued that each father or mother could request a visit through conciliation and invite the other party to dialogue and reach an agreement, or go directly to the court.

“Nothing justifies the fact that a child can be separated from his father or mother. Even the Convention on the Rights of the Child considers this fact as human, to see his parents, to have contact with them and that he can only be separated from his parents. for serious reasons, duly proven in court,” Lorena Meza’s lawyer recalled.

In this sense, in the “Family and Justice” sequence, he warned that if the obstruction of one parent that prevents the child from seeing the other parent is repeated, this can cause a change in tenure and that this is in favor of the other parent, this is the most a serious consequence that can be, in addition to disobedience to authority and disrespect.

He also said that in the case of minors, the visiting regime could be extended even to grandparents or any other relatives who, by communicating with the child, benefit him.

Finally, he explained that there are also cases when adult children want to see their parents, but for some reason they are prevented, for which they can also go to court or reconciliation.
