Erika Anchante, Deputy Representative for Women’s Rights Ombudsmanclarified that the change in the rule on child ownership was intended to make joint custody of children mandatory, which he considered disadvantageous.
He recalled that legislation has always had exclusive property, but now seeks to divide it.
In the RPP episode “Family and Justice”, Anchante indicated that Ombudsman Rejects approval of a text that proposes to regulate joint custody as mandatory, believing that this will have negative consequences if the right of children to maintain a personal relationship of direct contact with their mother and father is not first assessed.
The lawyer added that the rule is intended to encourage conflicting parents to come to an agreement and only go to court to regulate joint custody; however, it deserves further discussion and better study.
The specialist said that it should be taken into account that joint custody is not new in our legislation, since it has been in force since 2008 and is included in the code for children and adolescents.
Erica Anchante noted that the most commonly used modality of exclusive ownership, in which ownership passes to one of the two parents, and therefore they require further study, discussion and discussion on this issue.
