Family lawyer Janet Biaggi argued that when a father does not want to acknowledge his son, the mother should file a lawsuit against the father, enclosing the child’s birth certificate.
In the “Family and Justice” RPP sequence, he specified that in this case the judiciary would convene a hearing and in the same order the defendant would be referred, and if he agreed and acknowledged in the answer that he was his son, the judge would declare the suit founded. “In the same requirement, the mother may also demand alimony,” the specialist added.
Biaggi’s lawyer said that if the father objects to the lawsuit, he must undergo a DNA test and bear all costs of the examination, which includes him as the alleged father, mother and son, the cost of which is approximately 1110 soles.
In the episode “Family and Justice”, he noted that if the test is positive, the judge will make a paternity plea and call a second hearing to determine child support.
“If the parents are married, the recognition is immediate because the child is assumed to be the husband’s, in which case there is no question of separate recognition, which only arises when the parents are unmarried,” he explained at the RPP.
