Callao: Court condemns subject for impregnating and maintaining a sentimental relationship with a 13-year-old girl

According to the Ministry of Health, the mother found out about her daughter’s pregnancy when she was 14 years old and she was 4 months pregnant. The subject had a sexual relationship with a girl under the age of 13, and according to a psychological assessment, the victim had some mental retardation.

The law specifies that a minor under the age of 13 does not yet have sufficient discernment to engage in sexual relations. Article 173 of the Penal Code states that any person who has carnal access by vaginal, anal or oral route, or introduces objects or body parts in one of the first two ways to a minor, will be sentenced to life imprisonment.
