A big controversy was the delivery of the chat history facebook mothers and daughters to the Nebraska police as part of an investigation abortion illegal.
According to court documents, the state issued a court order to transmit Messenger messages to 41-year-old Jessica Burgess and her 17-year-old daughter Celeste.
Abuse of personal data
According to the Madison County Attorney, the mother bought and delivered the abortion pills to her daughter. He later helped bury the fetus. However, both pleaded not guilty.
Under Nebraska law passed prior to Roe v. wade, abortion it is illegal 20 weeks after the fertilization of the egg.
According to an affidavit by Detective Ben McBride of the Norfolk Police Investigation Division, Burgess had abortion spontaneously when she was about 23 weeks pregnant, shortly after taking the abortion pills.
Role of Facebook
In this case, McBride requested and received a court order to access both women’s digital lives, confiscating cell phones and laptops and demanding facebook to deliver mutual chats.
facebook stores most user information in plain text on its servers, which means the company can access it if it is forced to do so by a court order. The company regularly complies with the requirements of law enforcement agencies.
facebook messenger offers end-to-end encryption, which means chats between two users will only be visible on the users’ phones and cannot be read facebook nor by any governmental body submitting a legal request to the company. But the option is only available for people who use the app Messenger on mobile devices, and messages are only encrypted after users select the option to mark chats as “secret”.
Reports say the mother talks to Celeste “about what she asked for last month” and tells her to take the pills 24 hours apart.
Prosecutors charged Jessica Burgess with three felonies and two misdemeanors and Celeste Burgess with one felony and two misdemeanors. All accusations related to performing an abortion, hiding the body and providing false information.
