Judge agrees with Twitter: Elon Musk’s trial will take place in October

Twitter won the first victory in a lawsuit against Elon Musk after the Chief Justice accepted his request for a trial in the same year 2022.

At a July 19 hearing, Delaware Court Chancellor Kathleen McCormick agreed to the request Twitter to have an accelerated five-day trial starting this October.

Initially, Twitter wanted the trial to take place in September, four days later, so that Elon Musk complete its $44 billion purchase contract.

And while it’s not exactly a victory for the social network, it’s close to what he expected, as opposed to what the mogul’s defense demanded.

“Musk was and remains contractually obligated to make every effort to close this deal,” said Musk’s chief attorney. Twitter, William Savitt, during the hearing. “What you are doing is the exact opposite: it is sabotage.”

Kathleen St. Jude McCormick said that Musk’s team “underestimates the ability of this court … to handle complex lawsuits quickly.”

Elon Musk wanted trial in 2023

Musk’s lawyers asked the court to postpone the case until February 2023. They stated that Twitter suddenly rushed to end the lawsuit and force the acquisition after two months of alleged “delays and obfuscation” of requested data related to bots and other fake accounts.

According to Elon Muskthe lawsuit is moving too fast given that the agreement between Twitter and the mogul set a “best before” date of 24 October.

“The main controversy about fake and spam accounts is critical to the value TwitterMusk’s lawyers wrote during his first inquiry, echoing the billionaire’s opinion that led to the suspension of the purchase. “It’s also extremely fact-packed and expert, takes a long time, takes time to discover.”

At this point, there’s a chance that Musk might have to make a purchase before the end of the year, no matter how much he regrets his offer.
