The Constitutional Commission has approved Congressional Draft Resolution 2694-202, which seeks to include in Congress Rules removal of the president. With 14 votes in favor and 8 against, a decision was given the green light to remove head of state Pedro Castillo from office with just 66 votes.
“The Constitutional and Regulatory Commission, in accordance with article 70, paragraph b, of the Standing Orders of the Congress of the Republic, recommends the adoption of a legislative resolution incorporating subparagraph g) of Article 68 and Article 89-A of the Standing Orders of the Congress of the Republic of Congress, contained in the draft Legislative Resolution of the Congress (…) with goal regulate the procedure for suspending the powers of the President of the Republic for the reasons stated in subparagraph 1) of Article 114 of the Political Constitution of Peru” can be read in the document.
In addition, the aforementioned working group endorsed the view to postpone the general elections to 2023. With 11 votes in favor and seven against, a green light was given to continue with the possibility of extending both the presidential formula next year and the bulk of the current parliamentarians.
Due to the fact that this is a constitutional reform, it needs be approved by a qualified vote (87 votes) in two legislatures or, otherwise, be ratified in a referendum if it receives 66 votes.
parallel vacancy
In addition to the approved opinions, Congress continues the vacancy proposal submitted by non-member MP Edward Malaga. Today it is supported by 67 congressmen. However, some lawmakers have called for members of pro-government assemblies to support the process.
If a plenary session is called, President Pedro Castillo or his lawyer may go to the Chamber to exercise their right to a defense. After discussion, a vote will be taken. Consent of at least 87 legislators required for the vacancy to take effect.
