Congressman from Country SuccessDiego Bazan, referred to the bill that he presented with his colleagues Rosselli Amuruz D Norma Yarrow amend the Internal Rules of Congress and reduce the number of votes required to elect a presidential vacancy.
an initiative that discussed last Wednesday 21 in the Constitutional Commissionoffers go from 87 to 78 votes to make effective the departure of the President of the Republic, Pedro Castillo. With this in mind, Bazan argued that the challenge was not only to win votes, but to convince some parliamentarians not to oppose the measure.
“We cannot have veto power because we cannot make decisions in the hands of a small group of congressmen. Yesterday, some congressmen stressed how difficult it was to elect a member of the Constitutional Court, given that 87 votes were required. I think that the problem is not to get 87 votes, but to get those 44 votes that do not mind to any action or measures in these circumstances,” he said in a News Extension from PTR.
Diego Bazan pointed out that, in accordance with the current rules the head of state can convince 44 congressmen to remain in office instead of 87 parliamentarians.
“Today it is easier for the President of the Republic: instead of convincing these 87 congressmen one by one that he is doing the right thing, or that his government is doing well, or that he is not involved in difficult issues, go to convince “God knows how, 44 congressmen and tell them not to touch him and release him,” he added.
Crisis on the benches
On the other hand, Diego Bazan acknowledged that excessive rotation of benches prevents parliamentary groups from reaching an agreement among themselves and that the “right to vote” of some congressmen prevents an agreement.
“This is a real problem, this is a problem that exists: the lack of institutionalization in political parties, the lack of cohesion of the factions themselves. We saw it. We didn’t start with that many factions. more But any will to agree is broken because a small group of congressmen have the right to vote”, he decided.
In addition, he indicated that his proposal did not contradict the Constitutional Court’s call for the number of votes needed to fill a vacancy.
“The Constitutional Court in its appeal indicated that there could not be fewer votes than required for censorship. We know that there are 66 votes to censor a minister. We know that there are 66 votes for the political process in addition to the votes of the Permanent Commission. 78 votes still turn out to be one or two votes higher than this exhortation of the TC. I am quite respectful of what the court points out. Did not indicate, there is no judicial practice on the vacancyThat is why yesterday I asked the Chairman of the Constitutional Commission to call the country’s best constitutionalists for a technical analysis of my proposal, which, I am sure, has a technical and constitutional basis,” he concluded.
