The National Authority for Higher University Education (Sunedu) issued a decision this Friday following the ruling Second Constitutional Court of Lima order Congress of the Republic temporarily suspend the amendments to University law. This is stated in the statement of the institution.
According to the court resolution, Congress should temporarily paralyze the application of the amendment of sections No. 1, 12, 15, 17, 20 and the first final supplementary provision of the University Act.
“We welcome the decision Power of attorney to protect the right to a quality higher education, declaring the Congressional rule non-applicable and ruling for immediate sentencing in a lawsuit filed by Sunedu”, the agency said in a statement.
Power of attorney announced last Tuesday the ruling of the Second Constitutional Court of Lima, which announced the amparo lawsuit filed by Sunedu against a law that changes several articles of the Universities Law.
Parliament made official yesterday, in the official gazette Peruvian manamendments to the Law on Universities, despite a court decision that declared the legislative process null and void.
Sunedu criticized this action by Congress when they were already aware of the court decision that ordered them to suspend the process.
“A court ruling invalidated the legislative procedure that has been carried out so far Congress of the Republic. Upon receiving such notification, SUNEDU immediately sent letters to the Parliament and Editora Perú, urging them to comply with the provisions of the said regulation. However, on July 21, 2022, the Legislature published Law No. 31520, which amends the Law on Universities.
University counter-reform
Plenary session of the Congress approved last week at the urging of an autograph of a law weakening Suneda’s autonomy. The rule changes the composition of the board of directors of the university, and rectors of universities will be re-elected.
The norm was approved by 72 votes to 39, with 4 abstentions. Congress approved the bill last May in a second vote on the grounds that it restores the autonomy and institutionality of Peruvian universities.
Legislative initiative amends the composition Board of Directors from Sunedu, which will include two representatives from public universities, one from private universities, one from Concytec, one from Sineace, one from Minedu and one from Council of Deans of Professional Associations of Peru.
Pedro Castillo’s government complied with the measure, stating that the law constituted “a violation, a certain threat, or an imminent violation of university autonomy, when, on the contrary, it recognizes it and develops its dimensions extensively.”
