The President of the Republic, Pedro Castillo, appealed against the court ruling rejecting his request to be excluded from the preliminary investigation conducted by the prosecutor’s office. prosecutor’s office for the case “Decentralized Provias Puente Tarata”.
In said appeal, presented by his lawyer, Benji Espinoza, the President expressed his disagreement with the ruling of Chief Justice Juan Carlos Chekli Soria, which declared unfounded the defense of rights they filed to strike down a tax provision requiring their inclusion in this preliminary investigationR.
The appeal proposes to cancel the decision and recognize the protection of rights as justified, given that the judge made a mistake when analyzing the interpretation of Article 117 of the Constitution in terms of presidential immunity.
It is also indicated that prosecutor’s officeconducting an investigation, the president violates the order established by constitutional law and affects legal certainty, making the actions of government officials unpredictable.
Process
If said appeal is declared “in good faith” by Judge Chekli Soria, it will be forwarded to Permanent Criminal Division of the Supreme Court for said resource to be evaluated at a virtual hearing that will be scheduled with the parties involved to make a final decision on the matter.
President Pedro Castillo is under investigation by the National Attorney’s Office for alleged crimes of a criminal organization, aggravated trading in influence and aggravated conspiracy to the detriment of the state as a result of the said case, in which former Minister of Transportation and Communications Juan Silva and a group of congressmen from the People’s Party action”.
