The plenary session of the National Council of Justice (JNJ) announced this Thursday that it has dismissed the judge of the Huancayo First Preliminary Investigation Court. Emiliano Arturo Ramos Cardenasfor presenting false documents to justify his absence from court while he was in Colombia.
In the presentation of Disciplinary Procedure No. 029-2021-JNJ by Vice President Antonio de la Jaza, it was proven that Judge Ramos Cárdenas attempted to deceive and surprise the institution by presenting a medical certificate with false information, believing that no one could have known about his trip abroad .
“Having not achieved an advance payment on vacation, he nevertheless decided to go on a trip and, using a false certificate, requested rights with a loan. The defendant tried to deceive and surprise the competent officials so that he was granted sick leave and exacted his remuneration without any discount, ”Antonio de la Jasa explained at a hearing at the National Council of Justice.
In this sense, complete jnj determined that Emiliano Arturo Ramos Cárdenas had committed a very serious offense under article 48, paragraph 13, of the Judicial Career Law, and unanimously issued a sanction for dismissal.
The National Council of Justice is a constitutionally autonomous and independent body that is subject to the Constitution, its organic law and other laws on the subject.
One of its functions is to sanction the dismissal of judges and prosecutors, full-time and temporary, at all levels. As well as the head of the National Bureau of Electoral Processes (ONPE) and the National Registry of Identity Cards and Civil Status Records (Reniec).
JNJ appoints Delia Espinoza as chief prosecutor
The plenary meeting of the National Council of Justice (JNJ) has appointed lawyer Delia Milagros Espinosa Valenzuela as supreme prosecutor after the ministry of the prosecutor’s office approves the position and requests her immediate call.
The justice of the peace was on the reserve list of candidates for the election of sitting supreme prosecutors, where she was third on the merit list.
According to the Regulations on the Competition for the Selection and Appointment of Judges and Prosecutors, the National Council of Justice selects from the reserve those candidates who can occupy new positions vacated during the year.
After taking the legal oath and conferring the appropriate title, Dr. Espinoza Valenzuela will be able to serve on the Council of the Supreme Attorney’s Office, like her colleagues Liz Patricia Benavidez Vargas, the newly elected State Attorney of the Nation, and Dr. Juan Carlos Villena Campana.
