Minister Luis Gavidia declares the self-defense committees law unconstitutional

Defense Secretary José Luis Gavidia announced that he is preparing to file a lawsuit against the unconstitutionality of a law passed at the urging of Congress that recognizes self-defense and rural development committees and includes them in the citizen’s security system.

During a presentation on the seizure of 1,650 kg of cocaine hydrochloride obtained from various joint operations with the Peruvian National Police (PNP) in the Apurimac, Ene and Mantaro (Vraem) valley region, he indicated that the rule was “dangerous because these groups can fall into the hands of indiscriminate people.”

“We are going to look into this issue of unconstitutionality because it is very dangerous, we are still working and we have time to (prepare) an action of unconstitutionality. (Congressmen) They want us to settle the law and fix it there, but the law needs to be adjusted from the moment it’s dictated,” he said.

In this sense, the minister clarified that there is opposition to the fact that the guards are trained and equipped with special equipment, “but if we allow people who do not have any training and control to arm themselves.”

Similarly, he announced that he would go to the Constitutional Commission when its President, Patricia Juarez, invited him to give his opinion on the proposal to return to the bicameral system and change various articles of the Constitution.
